§ 1 Scope
(1) These Terms and Conditions (hereinafter "T&C") apply to all contracts concluded between Richard Nadler, Osterwaldstraße 100, 80805 Munich, Germany (hereinafter "Seller") and the customer (hereinafter "Customer") via the online shop richardnadler.com.
(2) The online shop is exclusively directed at consumers within the meaning of § 13 BGB (German Civil Code). A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.
(3) The version of these T&C valid at the time of the order shall apply.
(4) Deviating terms of the Customer shall not be recognised unless the Seller expressly agrees to their validity in writing.
§ 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order (invitatio ad offerendum).
(2) By submitting an order via the online shop, the Customer makes a binding offer to purchase the goods contained in the shopping cart.
(3) The Seller confirms receipt of the order immediately by automated email (order confirmation). This confirmation does not constitute acceptance of the offer.
(4) The contract is concluded when the Seller accepts the Customer's offer by an express declaration of acceptance (order confirmation) or by dispatching the goods.
§ 3 Prices and Shipping Costs
(1) All prices quoted are final prices and include the applicable German value added tax (currently 19%).
(2) Delivery is free of charge worldwide. No additional shipping costs apply.
(3) For deliveries to countries outside the European Union, additional customs duties, import taxes, and other charges may apply. These are not collected by the Seller and must be paid by the Customer directly to the relevant customs or tax authority. Customers are advised to inform themselves about the import regulations applicable in their country before placing an order.
§ 4 Payment
(1) Payment is processed via the payment service provider Stripe. The following payment methods are offered: credit card, debit card, and other payment methods available through Stripe.
(2) Payment is due immediately upon completion of the order.
(3) The Seller reserves the right to exclude certain payment methods.
§ 5 Delivery
(1) Delivery is made to the delivery address provided by the Customer.
(2) The estimated delivery time is 5–10 business days within Germany, 7–14 business days within the EU, and 10–21 business days for worldwide shipping after conclusion of the contract and receipt of payment, unless a different delivery time is stated on the respective product page.
(3) If the Customer is in default of acceptance or violates other duties to cooperate, the Seller is entitled to claim the damage incurred, including any additional expenses. Further claims remain unaffected.
(4) For consumer contracts, the risk of accidental loss or accidental deterioration of the goods shall not pass to the Customer until the goods are handed over to the Customer (§ 475(2) BGB).
§ 6 Retention of Title
The delivered goods remain the property of the Seller until full payment has been made.
§ 7 Right of Withdrawal
Consumers are entitled to a statutory right of withdrawal. Details are set out in the withdrawal policy, which forms part of these T&C and is communicated to the Customer separately.
§ 8 Warranty
(1) Statutory warranty rights apply.
(2) The limitation period for warranty claims for new goods is two years from delivery of the goods.
(3) The Customer is requested to report goods with obvious transport damage upon delivery and to inform the Seller accordingly. Failure to do so shall have no effect on the Customer's statutory warranty rights.
§ 9 Liability
(1) The Seller is liable without limitation for intent and gross negligence, as well as for damages arising from injury to life, body, or health.
(2) In cases of slight negligence, the Seller is only liable for breach of a material contractual obligation (cardinal obligation). In this case, liability is limited to the foreseeable, contract-typical damage.
(3) The above limitations of liability do not apply to claims under the Product Liability Act (Produkthaftungsgesetz) or in cases of fraudulently concealed defects or assumed guarantees.
§ 10 Copyright
(1) All artworks displayed in the online shop and their reproductions are protected by copyright. The copyrights belong to the artist Richard Nadler.
(2) The purchase of an art print entitles the Customer exclusively to private use. Reproduction, distribution, public display, or commercial use of the prints or the underlying motifs is not permitted without the express written consent of the Seller.
§ 11 Applicable Law and Jurisdiction
(1) The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the Customer is a consumer within the meaning of § 13 BGB, the mandatory consumer protection provisions of the state in which the Customer has their habitual residence shall also apply insofar as they provide the Customer with greater protection (Art. 6(2) Rome I Regulation).
§ 12 Final Provisions
(1) Should individual provisions of these T&C be or become invalid, the validity of the remaining provisions shall remain unaffected.
(2) The language of the contract is German.
